Terms of Service

These are the Terms of Service you will be bound to when you become a client. Any specific portions of these terms that conflict with a signed agreement are superseded by the signed agreement’s terms. The remaining terms remain in effect.

For the purpose of these terms, “Service Provider” and “Us” are defined as Mazeebo LLC while “Customer” and “Client” refer to you.

Our Rights Pre-Contract

We reserve the right to refuse service to any potential customer for any reason except where prohibited by law.

Customer Payments

Customers must submit their payments by the invoice due date in full. Payments can currently be securely made via Stripe in our customer support center. Additionally customers can sign up for subscriptions which will automatically process each month’s payment via Stripe, this can also be achieved in our customer support center.

We do not store or process customer financial data such as credit cards numbers on any of our servers, this is all handled by our secure payment processor (Stripe).

AWS WordPress Hosting & Managed Cloud Hosting

Our “AWS WordPress Hosting” and “Managed Cloud Hosting” services includes our management services for AWS as required to support running WordPress in AWS. Support and management is limited to the specific relevant resources, as well as cost optimization for relevant AWS resources.

Our “AWS WordPress Hosting” and “Managed Cloud Hosting” don’t require a contract, terms on this page still apply however. Invoices are due monthly for continued service.

Limitation of liability

You will always be solely liable for the following items:

  • Any content hosted, posted, shared, transmitted, or stored.
  • Maintaining the security of your credentials, applications, servers, accounts, and any other resources you own or utilize.
  • Any illegal activity you perform as well as any copyright infringement.
  • Your applications and code.

Additionally, any optional server hardening performed by us does not guarantee the security of your server, these actions are performed in good faith but in no way transfer ownership of these responsibilities. You still retain the full responsibility and liability for your account and resource’s security. By becoming a customer you agree that we cannot be held liable for any security related event.

Our Right To Terminate Abusive Customers

We reserve the right to terminate your account with Mazeebo, any resources located in any of our accounts, as well as your relationship to us as a client and any contract for any of the following reasons:

  • Illegal activity including copyright infringement.
  • Hate speech or threats of violence.
  • Abuse such as DDOS attacks.
  • Sending Spam.
  • Failure to pay for service.

We will never shutdown or terminate resources in your AWS accounts without your prior authorization. We do however reserve the right to terminate abusive resources in our own accounts without warning, and without waiting or providing a grace period and at our sole discretion. We also have no requirement to send any backups or data in these cases.

Limitations Of Support

Things considered to be out of scope (not included with any package or service):

  • Custom code development/debugging such as Lambda functions, applications, containers, and APIs.
  • Custom theme/plugin support.
  • End of life software.
  • Application installation/configuration (excluding projects).
  • Database administration.
  • Custom mail server configurations.
  • Application level security.
  • Penetration testing.
  • Stress/load testing. (Excluding projects)
  • Malware removal/remediation.

Our Rights Under Non-Payment

We will never shutdown or terminate resources in your AWS accounts due to non-payment as you own these resources, however, we also will not provide any support for said resources until payment is made in full.

We reserve the following rights when it comes to non-payment.

  • We may refuse service including any level of support and/or access to resources in our own accounts after 30 days at.
  • We may shutdown any resources in our own accounts, such as but not limited to web servers or websites being hosted after 30 days.
  • We may terminate any resources in our own accounts, such as but not limited to web servers or websites being hosted after 30 days.

Additionally we are under no obligation to provide any backups, copies, or other form of data to any customer that is delinquent by more than 30 days. We also cannot be held liable for any data lost due to non-payment, nor will we be liable to provide said data if payment is made after termination (60 days delinquent).

Our Responsibilities Post Contract Termination

All contracted responsibilities of Mazeebo LLC end on the effective termination date of said contract. This includes but is not limited to any future service or support as well as any hosting that is currently provided.

Additionally, we are not responsible for storing or providing any data, backups, or credentials post contract termination unless specifically stated otherwise in said contract.

We are in no way responsible for migrating any data and/or applications before a contract expires, this can however be requested as a project at our standard hourly rate.

Responsibility of AWS Charges

We are not responsible for any AWS related costs/charges including but not limited to AWS resource or service costs, this will always remain the full responsibility of the customer.

Governing Law and Legal Disputes

Any agreement and any matter or dispute arising out of or related to the subject matter of the agreement, shall be governed, construed, and enforced in accordance with the Laws of the State of West Virginia, without regard to its conflict of laws rules.

In no event shall Service Provider be liable to the Client or any other party for any special, exemplary, incidental, or consequential damages, including but not limited to lost profits, whether arising out of contract, tort, strict liability or otherwise. In no event shall Service Provider’s liability to Client exceed amounts paid by Client to Service Provider during the twelve months preceding the date upon which a claim arose. 

Client shall indemnify and hold Service Provider harmless from and against any and all third-party claims, costs, and liability arising out of Client’s use of the Services.
